Non-Regulatory Strategies

The Washington State Department of Ecology defines non-regulatory actions to include "a broad range of protection incentives and program alternatives: i) non-compensatory restoration, enhancement, and creation options; ii) acquisition and other land preservation techniques such as conservation easements, donations, land swaps, etc.; and iii) land use techniques such as transfer of development rights, and planned unit developments. [Note that any of these can be applied in the context of regulatory efforts. However, the capacity of the land should be a primary consideration in determining whether the use of any of these tools is appropriate.]”
